Blocked drain in a rental home: who pays in Belgium, tenant or landlord?

Short answer: The cause decides. A blockage from everyday use (hair, grease, a dropped object) is in principle the tenant's cost. Wear, a cracked or sunken pipe, or a defect in the installation is the landlord's. According to Mr Loodgieter (incl. 21% VAT), unblocking costs roughly €100 to €400 in 2026, depending on the location and the technique used.

The cause decides: use or defect

Small repairs and routine upkeep are the tenant's job; repairs caused by age or a defect in the building are the landlord's. The principle applies in all three regions, but each region sets it out in its own legislation.

For a blocked drain, that means first establishing why it is blocked. Only then is it clear who gets the invoice.

What do Flanders, Brussels and Wallonia say?

In all three regions the split of repairs is mandatory for a main residence; in Flanders the only exception is in the tenant's favour.

Flanders

The Flemish housing lease decree says the landlord keeps the property fit for use and carries out all necessary repairs except the tenant's. The tenant is responsible for small repairs and for repairs caused by use contrary to the purpose or by failing to report a problem. Repairs needed only through age or force majeure are the landlord's (art. 25 and 26). The parties may limit or exclude the tenant's repair duty, not widen it. Whether unblocking is on the official list of small repairs is best checked in that list; practical guides mostly assign it to the tenant, but the cause stays decisive.

Brussels

According to the Brussels authorities, the tenant carries out repairs and maintenance during the lease, except what is needed through wear or force majeure. The landlord does the other repairs, for example worn pipework or broken drainpipes. The tenant remains liable for repairs caused by negligent behaviour. The parties cannot deviate from this (Housing Code, art. 223). The page does not explicitly mention unblocking.

Wallonia

The official Walloon list is the clearest. It says the tenant ensures good flow in waste pipes, sewers and siphons and bears the cost of unblocking, unless the blockage is linked to a defect in the installation. The tenant also answers for damage caused by an obstructed downpipe or waste pipe, except for a construction defect. The landlord replaces defective elements through normal wear, age, chance event, force majeure or faulty installation. For a main residence you cannot deviate from this.

Small maintenance or structural defect?

A one-off blockage from use is small maintenance; repeated blockages, roots or a damaged pipe point to a structural defect.

A strong sign of a defect is a drain that blocks again every few weeks or months while the household lives normally. A blockage present from the start of the lease, or mainly after rain, also often points to the building rather than to use.

Have a professional assess the cause, preferably with a camera inspection. It shows whether there is only grease and hair, or whether the pipe is cracked, sunken or full of roots. That difference determines who pays.

Always report a problem quickly and in writing to the landlord. In Flanders the tenant bears damage resulting from late reporting (art. 26), and the Walloon list says the same about damage that worsens through passivity.

When does insurance help?

Home insurance mainly covers the consequential damage of water damage, not the upkeep or repair of the pipe itself.

Assuralia states that water damage is covered by home insurance and that the owner's insurer compensates damage to the building. That insurer can seek recovery from the tenant if the damage results from the tenant's fault; the tenant can then call on tenant's liability cover. Under art. 1732 of the Civil Code (in Flanders: arts 29 and 39 of the Flemish decree), the tenant is presumed liable for damage unless they prove it occurred without fault.

The same page excludes damage due to lack of maintenance or precaution and the repair of the pipe or appliance that caused the damage. It does not discuss unblocking as such, so check your policy conditions or ask your insurer.

After damage: stop the cause, take photos, request repair quotes, keep invoices for urgent repairs and report the claim quickly.

What does unblocking cost in Belgium in 2026?

Unblocking costs roughly €100 to €400 according to Mr Loodgieter (incl. 21% VAT); a complex main line with camera and high-pressure work sits at the top of that range. Figures differ by source, partly because some include VAT and others do not, and ontstopping.be applies 6% VAT for dwellings older than 10 years. These are market ranges, not fixed rates.

Outside office hours the price rises. ontstopping.be cites surcharges of about +50% (evening) to +150% (night); Mr Loodgieter mentions 50 to 100% and an emergency total of €200 to €500. More detail in our guide to drain unblocking cost in Belgium.

What drives the price, and VAT

The price depends mainly on the location, the technique, accessibility and the time of the call-out.

For grants or loans, refer to the official regional portals; a blocked drain is not in itself a subsidised job.

Documenting the cause and comparing quotes

A cause recorded in writing avoids arguments over the invoice.

  1. Report the problem immediately and in writing (email or registered letter) to the landlord, with date and photos.
  2. Ask the professional to note in the report what was found: grease, hair, an object, roots, a cracked or sunken pipe.
  3. Request camera footage or photos and a short written statement of the cause.
  4. For a non-urgent repair the landlord must pay, get their written agreement before ordering, or you risk not being reimbursed.
  5. Keep the entry inventory; a blockage from the start may already be noted there.

For every quote, ask whether call-out, diagnosis, camera and VAT are included and whether an evening or weekend surcharge applies. Only compare quotes using the same technique. Alpha Services Benelux, active since 2014, works with its own team and gives a fixed written quote after a site visit; for plumbing there is a 24/7 emergency service. Frequently asked questions

Who pays for a blocked drain in a rental in Belgium?

It depends on the cause. Hair, grease or a dropped object: in principle the tenant. Age, roots or a cracked pipe: the landlord. In Wallonia the tenant bears unblocking costs unless the blockage is linked to a defect in the installation.

Who pays the plumber in a rented house?

Whoever is responsible for the problem. Damage from use and small maintenance fall on the tenant; age, wear and defects fall on the landlord. For a non-urgent repair, get the landlord's written agreement first.

Can the lease make the tenant pay for everything?

For a main residence, generally not. In Flanders, Brussels and Wallonia the split of repairs is mandatory. In Flanders a lease may limit or exclude the tenant's repair duty, but not extend it.

Does home insurance pay for unblocking?

Not automatically. Assuralia says water damage is covered, but not repair of the pipe that caused it or lack of maintenance. It does not address unblocking itself, so read your policy conditions.

How much does unblocking cost in 2026?

According to Mr Loodgieter (incl. 21% VAT), roughly €100 to €200 for a toilet, sink or shower and €250 to €400 for a complex main line. Out-of-hours surcharges are 50% to 100% per Mr Loodgieter and +50% to +150% per ontstopping.be.

How do I prove who is responsible?

Have a professional establish the cause, ideally with camera footage and a written report. Report the problem in writing to the landlord and keep the entry inventory, photos and invoices. That shows whether use or a defect is the cause.
